The minor plaintiff alleged that the attending obstetrician and a resident in training applied excessive traction during a low forceps delivery causing a cerebellar bleed and resulting in lower limb palsy and cognitive damage.

The plaintiff's Kurt Lloyd attorney hired an obstetrical expert who had published a leading textbook on forceps delivery to rebut the defense of an arterial malformation congenital defect causing an unavoidable bleed.
