I am pleased to have been able to bring to a successful close to a long pending product liability case. In 2010, the plaintiff who was a garbage truck driver was operating the hydraulic compaction system on a truck sold by a national garbage truck manufacturer, when he had all of his toes crushed and later amputated on his right foot.
In 2012, the case was originally filed by local counsel, and after I was retained as lead counsel in 2017, I was able to bring a new, novel post-sale failure to warn theory against the manufacturer which alleged that the manufacturer should have notified all of the original purchasers of its trucks about a an exposed, pinch-point that created a safety hazard and offered guarding device to prevent injury. The plaintiff and his family are overjoyed. I was happy that they could to put this tragedy behind them.
