The plaintiff's estate alleged a failure to diagnose a malignant lung tumor which caused a 16-month delay in diagnosis, treatment, and death. This case represents one of the few jury verdicts recorded on behalf of a lung cancer plaintiff. This verdict is also noteworthy for being one of the first in Illinois to award in excess of one million dollars for the wrongful death of a widowed woman over the age of sixty-five.
As plaintiff's attorney, Kurt Lloyd successfully retained one of the world's leading lung cancer surgeons, who testified that a person with a malignant lung tumor less than 3.0 cm in size has a seventy percent chance of survival with timely diagnosis and treatment.
